Do I need a visa for the USA? What are the visas for the USA?

Can you imagine being able to travel to the United States without having to apply for a visa? It may sound too good to be true, but it turns out that this situation has become a reality thanks to the visa-free travel between Poland and the USA, which means that traveling to this fascinating country has become much easier. The long-awaited abolition of visas to the USA has finally become a fact. This means that citizens of Poland and other countries eligible for the visa-free travel program will no longer have to apply for traditional tourist visas to the United States. It seems that a new era in travel to the USA has just begun!

US visa waiver – what does it mean?

The visa-free program that allows free entry to the USA opens up unlimited possibilities for travelers. Without the need to fill out long forms, wait for a meeting with the consul and nervously wait for an answer, planning a trip becomes easier and more enjoyable. In addition, the abolition of visas to the USA also brings other benefits. First of all, it contributes to the development of tourism and economic growth in both countries. The introduction of visa-free travel may significantly increase the number of foreign tourists visiting the United States. In turn, Polish tourists who dreamed of discovering the secrets of New York, the charms of San Francisco or great national parks can now fulfill their dreams without unnecessary formalities.

Types of visas for the United States

Visas to the United States vary depending on the purpose of your trip and the circumstances that prompt you to visit the U.S. Here are some of the main types of visas you can get:

  • Wiza turystyczna (Type B-2): Allows travel to the U.S. for recreation, tourism, family visits, sightseeing, or short-term, non-academic courses. It is valid for a specified period of time, usually up to 6 months.
  • Business visa (Type B-1): allows you to travel to the USA for the purpose of conducting business, attending conferences, training, trade negotiations, etc. This visa is also usually valid for up to 6 months.
  • Student visa (Type F-1): is intended for those who plan to study in the U.S. for full-time academic programs, such as bachelor's, master's, or doctoral degrees. The student visa also allows you to remain in the U.S. for a period of professional practice after completing your studies.
  • Exchange visa (Type J-1): for participants in international exchange programs such as internships, apprenticeships, cultural and educational programs, scholarships, scientific research, etc.
  • Work visa (type H-1B, H-2B, L-1, O-1, etc.): granted to foreigners who have been employed by American companies for specific positions or for a fixed period.
  • Visa for fiancées and spouses (type K-1, K-3): intended for fiancées and spouses of U.S. citizens who intend to get married in the U.S. and reside there permanently.

Is a tourist visa required for the USA?

Citizens of certain countries must obtain a visa before traveling to the United States. These include primarily those whose countries have not been included in the visa-free regime, but also those whose ESTA applications have been rejected. Also, if a traveler plans to stay longer, study, work or get married, they will usually need to apply for the appropriate visa that corresponds to the purpose of their trip. In some cases, the U.S. may impose visa restrictions for citizens of specific countries for political, security or other reasons. Citizens of these countries may be required to apply for a visa even for tourism or business purposes.

Additionally, individuals who have traveled to North Korea, Iraq, Iran, Syria, Sudan, Libya, Somalia, Yemen, and Cuba (after January 11, 2011) after March 12, 2021, will not be issued an electronic permit to enter the U.S. In such a situation, you should contact the U.S. Embassy in Poland in person.

How to enter the USA without a visa?

So how do you enter the US without a visa? The necessary document is ESTA, or Electronic System for Travel Authorization. ESTA allows you to travel to the US for tourist, business or transit purposes. In the case of tourist visits, you are allowed to visit attractions, relax on beaches, participate in cultural events, etc., a business trip includes, among other things, participation in conferences, meetings with clients or business partners, and the purpose of the trip allows for transit through the US on the way to another country. ESTA is valid for 2 years.

You can apply for ESTA online by filling out the appropriate form on the U.S. Department of Homeland Security website https://esta.cbp.dhs.gov/ . It is recommended to apply before your planned travel date, although you can usually get a response to your application within a few minutes. It is important to apply on the official website, as there are many third-party sites that may charge higher fees than the actual cost of ESTA and do not guarantee authorization. A positive ESTA authorization is tied to a specific passport. ESTA holders should have the electronic authorization printed and ready to present at the airport or border crossing when entering the U.S.

Visa-free travel to the United States – who does it apply to?

Visa-free travel to the United States applies to citizens of countries that participate in the Visa Waiver Program (VWP). Thanks to this program, citizens of these countries can travel to the United States for tourism or business without having to obtain a traditional visa. Instead of a visa, travelers from countries that participate in the program must obtain ESTA (Electronic System for Travel Authorization) authorization before traveling.

What obligations must be fulfilled after the US visa waiver?

To apply for ESTA, you must have a biometric passport valid until the last day of your planned stay in the U.S., be a citizen of a country participating in the VWP program, plan to stay in the U.S. for tourism, business or transit purposes, no longer than 90 days, and have no history of offenses that may preclude you from traveling without a visa.

How long can you stay in the United States without a visa?

Citizens of countries participating in the Visa Waiver Program, i.e. those with ESTA authorization, can stay in the United States without a visa for up to 90 days. This means that they can stay in the United States for a period not exceeding 90 days from the date of first entry. If a traveler plans to stay longer than 90 days, it is necessary to obtain an appropriate visa that corresponds to the purpose of the trip, such as a student, work or tourist visa. Stays longer than 90 days are not permitted under ESTA authorization. It is also important to note that the 90-day stay period can be accumulated over the entire validity period of the ESTA authorization. For example, if a traveler has an ESTA authorization for a period of 2 years, they can spend a total of up to 90 days in the United States during that period, but no more than 90 days during a single stay. If the passport expires earlier than the ESTA, the ESTA also expires on the same day.

How much does ESTA cost?

For some travelers, visa fees may have been an additional financial burden. Now, with the visa waiver, the savings can be significant, and gaining access to the United States is becoming more affordable. The ESTA application fee is usually $14. This is the standard application processing fee that covers the background check process and makes it much easier to travel to the United States under the Visa Waiver Program. It is worth noting that the ESTA fee is a processing fee and does not guarantee that authorization will be granted. When applying for ESTA, be sure to use the official website of the U.S. Department of Homeland Security (https://esta.cbp.dhs.gov/) to avoid additional fees and the risk of fraud.

The ESTA fee can be paid by credit or debit card. If you apply through a third party, there may be additional costs associated with the application process, so it is always recommended to use the official ESTA website to avoid unnecessary costs and confusion.
